Delivery
The ordered goods will be prepared for pickup, or the buyer will receive them at the delivery address within the time frame specified on the order confirmation, which the buyer received via email.
Withdrawal from Contract
In contracts concluded at a distance or outside business premises, the consumer has the right to notify the company within 14 days that they are withdrawing from the contract, without having to state the reason for their decision.
The consumer exercises the right to withdraw from the contract by notifying the company of their decision to withdraw via the email: hello@purekeynutrition.com.
The consumer does not have the right to withdraw from the contract for the supply of sealed goods not suitable for return due to health protection or hygiene reasons if the consumer has unsealed them.
In a sales contract, the withdrawal period begins on the day the consumer or a third person, other than the carrier appointed by the consumer, gains actual possession of the goods.
The consumer may submit the withdrawal notification to the company using the form from section 11 or by an unambiguous statement clearly expressing the decision to withdraw from the contract.
If the consumer has received the goods and withdraws from the contract, they must return or deliver the goods to the company or a person authorized by the company to receive the goods, immediately or no later than 14 days after notifying the company of the withdrawal from the contract unless the company offers to collect the returned goods itself.
It is considered that the consumer returns the goods in a timely manner if they send them before the end of the 14-day return period.
The consumer bears only the costs of returning the goods concerning the withdrawal from the contract.
The consumer is liable for any diminished value of goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
In the event of withdrawal from the contract, the company returns all received payments to the consumer immediately or no later than 14 days after receiving the withdrawal notification.
The consumer is not entitled to a refund of any additional costs incurred if they explicitly chose a type of delivery other than the least expensive standard delivery offered by the company.
In a sales contract, the company may withhold the repayment of received payments until the goods are returned or until the consumer provides proof that they have returned the goods, unless the company offers to collect the goods itself.

Non-conformity of Goods
The company supplies goods to the consumer and is liable for any non-conformities that existed at the time of delivery.
The goods are compliant with the sales contract, particularly when:
- They match the description, type, quantity, and quality, and possess functionality, compatibility, interoperability, and other attributes as required by the sales contract;
- They are fit for any particular purpose for which the consumer requires them and which was made known to the seller at the latest upon the conclusion of the sales contract, and the seller agreed to this;
- They are supplied together with all accessories and instructions, including installation instructions, as stipulated in the sales contract; and
- They are updated as stipulated in the sales contract.
The seller is liable for any non-conformity of the goods that exist at the time of delivery and becomes apparent within two years from the date of delivery.
It is presumed that any lack of conformity that becomes apparent within one year of delivery already existed at the time of delivery, unless the seller proves otherwise or if such a presumption is inconsistent with the nature of the goods or the nature of the non-conformity.
In the case of non-conformity of the goods, the consumer, who notified the seller of the non-conformity, is entitled, under the conditions and in the order specified in this section, to:
- Request the seller to restore the conformity of the goods free of charge;
- Request a proportionate price reduction or withdraw from the sales contract and request a refund.
The consumer may withhold the payment of the remaining purchase price or a part of the remaining purchase price until the seller fulfills their obligations under this section. The consumer exercises this right by notifying the seller of their decision.
In any case, the consumer also has the right to demand compensation from the seller for damages, particularly the reimbursement of the costs of materials, spare parts, labor, transportation, and goods returns, incurred as a result of the warranty claim for the non-conformance of goods.
The consumer may request the seller to restore the conformity of the goods free of charge within a reasonable time from notifying the seller of the non-conformity, not exceeding 30 days, without significant inconvenience to the consumer, taking into account the nature of the goods and the purpose for which the consumer needs the goods.
The period from the previous paragraph may be extended to the shortest possible time necessary to complete the repair or replacement, but by no more than 15 days. When determining the extended period, the nature and complexity of the goods, the nature and seriousness of the non-conformity, and the effort required to complete the repair or replacement shall be taken into account. The seller informs the consumer of the number of days for extending the period and the reasons for the extension before the expiry of the period from the previous paragraph.
It is considered that the conformity of goods is restored free of charge if the seller bears any necessary costs incurred to restore conformity, particularly shipping, transportation, labor, or material costs.
The seller may refuse the consumer’s warranty claim to restore the conformity of the goods if repair and replacement are impossible or would incur disproportionate costs considering all the circumstances, including those from the previous paragraph.
Regardless of the previous paragraph, the consumer may withdraw from the sales contract and claim a refund if the non-conformity appears within 30 days of delivery.
If the consumer requests a proportional price reduction, the reduction is proportional to the diminished value of the goods received, compared to the value they would have if they were compliant.
The consumer exercises the withdrawal from the sales contract by notifying the seller of the decision to withdraw.
If the non-conformity only relates to a part of the goods delivered under the sales contract and there is a reason for withdrawal in accordance with the first or second paragraph of this section, the consumer may withdraw from the sales contract concerning that part of the goods and any other goods obtained together with the non-conforming goods if it is unreasonable for the consumer to retain only the conforming goods.
When the consumer withdraws from the sales contract, the consumer returns the goods to the seller at the seller’s cost.
The consumer cannot withdraw from the sales contract if the non-conformity is only minor. The burden of proof regarding whether the non-conformity is minor falls on the seller.
The consumer can assert their rights regarding non-conformity if they notify the seller within two months from the day the non-conformity was identified.
In the notification of non-conformity, the consumer must describe the non-conformity in detail.
The consumer can notify the seller of the non-conformity in person, whereby the seller issues a receipt, or it can be sent to the store where the goods were purchased, or communicated to the seller’s representative with whom the sales contract was concluded.
The consumer allows the seller to inspect the goods claimed to be non-conforming.
If the existence of the non-conformity of the goods is disputed, the seller notifies the consumer in writing within eight days of receiving the consumer’s warranty claim.
When the consumer withdraws from the sales contract, the seller refunds the paid amount to the consumer immediately, but no later than eight days after receiving the goods or proof that the consumer has sent the goods back.
When the consumer requests a proportional price reduction, the seller returns the part of the purchase price within eight days of receiving the consumer’s request for a proportional price reduction.
Rights from this act expire two years from the day the consumer notified the seller of the non-conformity of the goods.
